A new congressional report Friday challenged President Bush's authority for domestic eavesdropping.
The report from the respected and non-partisan Congressional Research Service said the president's rationale for authorizing domestic electronic eavesdropping on U.S. citizens without warrants rests on questionable legal ground and "may represent an exercise of presidential power at its lowest ebb," the New York Times reported.
The legal rationale for authorizing the National Security Agency monitoring "does not seem to be as well-grounded" as the Bush administration's lawyers have suggested, the report said. Congress did not appear to have intended to authorize warrantless wiretaps when it gave Bush the authority to wage war against al-Qaida after the Sept. 11, 2001 mega-terrorist attacks, it said.
